A Marion man, convicted in the 2013 shooting death of his girlfriend, will soon be re-sentenced in McDowell County Superior Court - that decision handed down by the North Carolina Court of Appeals. 26-year-old Darian Mosley was found guilty of second-degree murder in the death of 40-year-old Amy Renee Parker in May 2016. Mosley was sentenced to a minimum of 20-years in prison. Mosley's defense appealed the decision and in October, the state's court of appeals granted Mosley an appear - stating the trial court erred in sentencing the defendant as a class B-1 offense - against North Carolina General Statutes. Mosley's re-sentencing is scheduled for February 26th at 10am in McDowell County Superior Court.
